General Terms and Conditions

1. Preface

The following conditions of delivery and payment form part of all of the firm Giseh publications supply contracts. They also apply to all follow up business. Any general terms and conditions of purchase shall not be applicable. Changes to our general terms and conditions are only valid if agreed in writing.

2. Prices

Charges are based on the current price list (shop) on our internet site www.giseh.net. Prices in our printed materials are subject to change and are not authoritative.  All prices include sales tax at the current rate.

3. Payment

Unless otherwise agreed payment is due within 8 days.

4. Late payment

In case of late payment the entire outstanding amount of Giseh publication’s payment request is due. As well as the legal amount of default interest, costs incurred by Giseh publications for administration and where appropriate extra bank charges will also be imposed.

5. Reservation of proprietary rights

All deliveries are subject to the reservation of proprietary rights. All goods supplied remain the property of Giseh publications until full payment is received.

6. Delivery

Following dispatch from our warehouse, the buyer has liability for the goods.  Unless otherwise agreed deliveries will be sent by the German postal service (Deutschen Post AG). Postage and packing costs 7.54 Euros for each consignment. Deliveries abroad must be paid in advance, including any extra delivery charges. These charges are available on request. 

7. Guarantee

We should be notified immediately of any defects in the goods, at the very latest within        24 months of receipt. The invoice should be presented together with notification of defects. Obvious defects should be reported to us in writing within 7 working days.  In the case of justifiable complaints made within the due date we may in the first instance make use of our right to rectify the defects. Giseh publications reserve the right to repair the defect or to provide a replacement to the same value.  If at the second attempt repairs are unsuccessful the buyer can demand a reduction in the price or the cancellation of the contract. The guarantee does not include defects out with our control or those caused by incorrect use.  Warranty claims are invalid if the defect is due to the instructions for the care and use of the product not being followed, or due to interference or changes by unauthorised third parties.

8. Returns

All goods are strictly non-returnable, in cases where by our goodwill returns are allowed, a return fee of 10 Euros will be charged. Returns can only be accepted with the invoice and the original packaging. Any returns in a condition which precludes re-selling will not be accepted and will again be made available to the buyer who will be liable for any costs incurred.

9. Cancellation and returns rights according to German civil code (BGB)

Instead of the cancellation rights according to section 355 BGB we offer the right to return goods according to section 356 BGB.

10. Delivery conditions

Part delivery is always possible. Delivery costs may be charged for each delivery.

11. Final provisions

The contract is subject to German law. If clauses in the contract prove to be in whole or in part ineffective or incomplete, this does not affect the validity of the other clauses. The ineffective clause is to be replaced by a legally effective clause which is as close to the meaning and purpose of the original as possible. This clause should also be as economically close to the original as possible.

A legal contract between the customer and Giseh publications is entered into when the customer sends an order and we accept it (e.g. by telephone, email or by taking appropriate action).

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) oder - wenn Ihnen die Sache vor Fristablauf überlassen wird - durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor dem Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an:

Widerrufsfolgen

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung - wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre - zurückzuführen ist. Im Übrigen können Sie die Pflicht zum Wertersatz für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung vermeiden, indem Sie die Sache nicht wie Ihr Eigentum in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.

Das Widerrufsrecht besteht

1. nicht bei Fernabsatzverträgen zur Lieferung von Waren, die nach Kundenspezifikation angefertigt werden oder eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind oder die auf Grund ihrer Beschaffenheit nicht für eine Rücksendung geeignet sind oder schnell verderben können oder deren Verfalldatum überschritten würde.

Allgemeine Hinweise

1. Bitte vermeiden Sie Beschädigungen und Verunreinigungen der Ware. Senden Sie die Ware bitte möglichst in Originalverpackung mit sämtlichem Zubehör und mit allen Verpackungsbestandteilen an uns zurück. Verwenden Sie ggf. eine schützende Umverpackung. Wenn Sie die Originalverpackung nicht mehr besitzen, sorgen Sie bitte mit einer geeigneten Verpackung für einen ausreichenden Schutz vor Transportschäden.

2. Senden Sie die Ware bitte möglichst nicht unfrei an uns zurück. Wir erstatten Ihnen auch gerne auf Wunsch vorab die Portokosten, sofern diese nicht von Ihnen selbst zu tragen sind.

3. Bitte beachten Sie, dass die vorgenannten Ziffern 1-2 nicht Voraussetzung für die wirksame Ausübung des Widerrufsrechts sind.
